Published Site Visitor Terms

These Published Site Visitor Terms (“Visitor Terms”) govern your access to and use of a business website created, hosted, or supported through the Efficio platform (a “Published Site”). The business identified on the Published Site (the “Business”) is responsible for its products, services, offers, content, and relationship with you. EFFICIO MARKETING LLC, an Ohio limited liability company, provides website technology, hosting, lead-delivery, call-routing, and related platform services.

By accessing or using Efficio-provided Published Site functionality after these Visitor Terms are made available, you agree to these Visitor Terms to the extent permitted by applicable law. If you do not agree, do not use that functionality. You are a Visitor, not an Efficio business customer or Owner, and your activity does not authorize you to act for or bind the Business. Nothing in these Visitor Terms limits a consumer right or remedy that cannot lawfully be limited.

The Business may publish additional terms and notices governing its products, services, transactions, and relationship with you. Those terms control that relationship; these Visitor Terms govern only your use of Efficio-provided Published Site functionality.

A form, chat, appointment request, call, booking link, order link, or other submission asks the Business to contact or assist you. It is not acceptance of an appointment, order, price, professional engagement, emergency request, or service unless the Business separately confirms it. Published Sites and Efficio are not emergency services. For urgent medical, safety, legal, financial, or other time-sensitive needs, contact an appropriate qualified provider or emergency service directly.

You represent that information you submit is accurate, that you are authorized to provide it, and that the Business may respond through the contact method you request or supply, subject to applicable law. A request for contact does not by itself authorize unrelated automated marketing calls, texts, or emails.

You must not use a Published Site to:

• violate law, infringe another person’s rights, impersonate someone, or submit information without authority;
• send malicious code, attack or probe systems, evade access controls, disrupt service, or abuse rate limits;
• submit unlawful, fraudulent, defamatory, threatening, exploitative, deceptive, or abusive material;
• scrape or harvest personal data, misuse contact information, or use automated means that burden the service;
• submit another person’s data without the notices, authority, or permission required for that submission; or
• submit passwords, financial-account credentials, government identifiers, protected health information, children’s data, precise location, biometric data, or other highly sensitive or regulated information unless the Published Site expressly requests it through a workflow that the Business is legally authorized to provide.

The Business generally determines why Visitor information submitted through its Published Site is collected and used. Efficio processes that information for the Business to deliver and operate the requested functionality, and may also process limited information for Efficio’s security, billing, fraud prevention, abuse prevention, legal compliance, service improvement, and dispute-handling purposes described in the Privacy Policy.

If you submit a form, appointment request, chat, quick-contact request, or similar interaction, you direct Efficio to transmit the submitted information and related context to the Business. If you call through an enabled forwarding or tracking number, Efficio and its telephony provider may route the call and process call metadata such as phone numbers, status, duration, and timestamps. Efficio’s Call Confirmation feature is not intended to record call audio.

Direct privacy requests about the Business’s relationship with you should ordinarily be sent to the Business. Questions about Efficio-controlled data may be sent to privacy@effic.io. Efficio may forward a request to the Business, respond regarding Efficio-controlled data, or assist the Business as required by applicable law.

The Business, not Efficio, selects and approves its Published Site content and is responsible for its claims, credentials, prices, reviews, availability, products, services, accessibility, and legal compliance. Efficio may provide hosting, templates, automated suggestions, and lead-delivery tools, but does not endorse or independently verify every Business, offer, credential, review, or statement.

Links, maps, booking tools, order tools, payment tools, phone services, social platforms, and other third-party services are governed by their providers’ terms and privacy practices. Efficio is not responsible for a third-party destination merely because a Published Site links to or uses it.

Published Site software, themes, interfaces, and platform materials are owned by Efficio or its licensors. Business content is owned or controlled by the Business or its licensors. You receive a limited, revocable, non-exclusive right to use the Published Site for its intended purpose. You may not copy, resell, reverse engineer, interfere with, or create a competing service from Efficio-provided functionality except as allowed by law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EFFICIO-PROVIDED PUBLISHED SITE FUNCTIONALITY IS PROVIDED “AS IS” AND “AS AVAILABLE.” EFFICIO DOES NOT WARRANT THAT A PUBLISHED SITE, BUSINESS, CONTENT, REQUEST, APPOINTMENT, CALL, MESSAGE, PRODUCT, OR SERVICE WILL BE ACCURATE, AVAILABLE, SECURE, ERROR-FREE, UNINTERRUPTED, OR SUITABLE FOR YOUR NEEDS.

Disputes concerning a Business’s products, services, conduct, content, or relationship with you are between you and the Business, except to the extent applicable law imposes responsibility on Efficio that cannot be disclaimed. Efficio remains responsible for its own non-waivable obligations.

To the maximum extent permitted by law, Efficio and its members, managers, officers, employees, contractors, agents, affiliates, suppliers, licensors, successors, and assigns will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, lost opportunity, reputational harm, or a Business’s acts or omissions arising from your use of a Published Site.

To the maximum extent permitted by law, Efficio’s total liability arising from Efficio-provided Published Site functionality will not exceed USD $100. These limits do not apply to liability that cannot lawfully be excluded or limited, and they do not reduce any mandatory consumer protection.

Efficio or the Business may restrict access to protect people, systems, rights, service availability, or legal compliance. To the extent permitted by law, you will be responsible for claims, losses, and reasonable costs caused by your unlawful misuse of Efficio-provided functionality, malicious activity, infringement of third-party rights, or submission of information you were not authorized to provide. This obligation does not apply to the extent a claim was caused by Efficio’s own unlawful conduct.

Subject to non-waivable consumer rights and conflict-of-law rules that apply where you live, these Visitor Terms are governed by New York law. State courts in Kings County, New York, and, where federal jurisdiction exists, the United States District Court for the Eastern District of New York have jurisdiction over disputes involving Efficio. Nothing prevents an eligible small-claims action or relief in another forum that applicable law requires.

Efficio may update these Visitor Terms prospectively. The version made available when you submit information governs that submission unless applicable law requires otherwise.
